View Full Version : Trial By Declaration rejected????

My friend submitted a Trial By Declaration(for speeding) a couple weeks ago and she got this in the mail..... anyones rejection look like this?....what else can be done?...

That's what it looks like. Contrary to popular belief, you don't always win the TBD's.

Now your friend should file for a Trial De Novo. That means the result of the TBD is thrown out and you get a brand new court trial. One more opportunity for the officer to not show up, and the longer the ticket stays off your insurance.

You have to file for it ASAP though. You only have 20 days from the day she received that notice.

how long does the TBD take for it to process in court. I send in my TBD couple month ago and have not heard anything from court, other than DMV "warning drive safe" slip.

I would call the court and ask about the status. If it's been 2 months you should have gotten something. Always be proactive.

I think you still have to pay the fine...even while you're waiting for a new trial.
