View Full Version : Beat my 22349 (b) with a TBD

I received a "not guilty" verdict yesterday on my latest TBD for a 22349 (b). :D This was for a 77 in a 55 I got from the CHP back in June.

I put about 10 hours of work into it. I included maps, diagrams, etc. along with my written statement. My defense was basically that the officer pulled over the wrong car. The cop made the mistake of admitting to me he lost sight of the vehicle he was pursuing and I based pretty much my whole defense on that. I used multiple "reasonable doubt" arguments. I also included a paragraph on the fact that the officer marked the ticket PM instead of AM, and that he signed the ticket under penalty of perjury.

I assume the officer turned in his declaration since the verdict was "not guilty" instead of a dismissal. That makes the victory even more satisfying. You gotta love the system sometimes. O0
