    i have always been honest and they usually appreciate it. They are not idiots. They know what time it is and so do you when getting pulled over. IMO, if the officer is being cool then be honest. If he or she is being not so cool then only admit to what you know he or she knows. Nothing more. I have been let go on alot of occasions hauling ass just by saying yes sir I was speeding and you got me. No excuses. believe it or not. I live practically on Mullholland and Kanan road so I rip the canyons alot. Been pulled over on average about six times a year and only have two speeding tickets. Three times i was pulled over for no front plate and only got a fix it ticket once. Maybe because I am older and white they give me a break, I don't know.

    I started to realize that the older I get the more tickets I get out of. And it's funny because as I get older, my cars get faster. Go figure :)

    "Did I do something wrong officer?"Â* (try to clarify the situation)

    It doesn't matter if you were or not, they are trying to get you to admit that you committed a crime.
    even tho this thread is a bit old, you can gather some great info that might help you under certain situations.
    Since what you just mentioned above has happen many times to all of us.. Great info!!!

    I followed the tips from this and it worked. the cop gave me a warning and let me go. i was headed home from work late at night and was swerving a lot and kinda going fast at the same time and just let me go.

    i will recomend anyone to print this out or try to remember it!

    I tried the military I.D. thing one time and the officer said "I don't need this" and tossed it back through the window at me, I just couldn't believe it!

    Oh and for the record, i got pulled by a chippy in north county, handed him my CAC card (dot mil contractor)and kindly explained to him that i was travelling over the speed limit because we had a last minute rescheduling of a training evo,ution for a marsoc unit and that i apologized and that it was no excuse. He gave me a "slow it down and semper fi" and let me go with a warning. Lucky i got an ex devil dog apparently.

    Damn...so the give us "normal" people a hard time. I've only been let off once for my tints because they cop felt bad for my dumb ass and saw that I was recently rear ended.

    I remembered my training! This got me off with a warning last night. Cops are all over in Westwood when they shut down the onramps....they were roaming the streets just looking for cars to pull over.

    Lets talk about what we should do when we're pulled over and the cop is trying to get you for illegal mods or is trying to give you a ref ticket and is trying to pop your hood. Let assume that we do have illegal loud aftermarket exhaust system and illegal under the hood modifications.

    Im assume the best corse of action is to say as little as possible act dumb and never admit guilt. They will ask if you have illegal mods and our answer will be no. When the ask if you can pop your hood for an inspection we should say no and refuse and just say I want to remain silent after than.

    after this do they have the right to ask us to steep out of the car and for them to go into the car and pop the hood themselves if we do not agree or let them?

    the fact of us having a loud aftermarket exhaust, is that enough probable cause for them to search our cars and under our hood without our consent?

    So many questions on different levels.

    Ok so first off you have this little section of the California Vehicle Code (CVC) that handles your first part:

    2806. Any regularly employed and salaried police officer or deputy
    sheriff, or any reserve police officer or reserve deputy sheriff
    listed in Section 830.6 of the Penal Code, having reasonable cause to
    believe that any vehicle or combination of vehicles is not equipped
    as required by this code or is in any unsafe condition as to endanger
    any person, may require the driver to stop and submit the vehicle or
    combination of vehicles to an inspection and those tests as may be
    appropriate to determine the safety to persons and compliance with
    the code.

    So they require reasonable suspicion to conduct a vehicle safety inspection (It isn't a search, it is an inspection), this is not probable cause...it is FAR less. It in a nut shell means if based on their training and experience they believe or suspect your vehicle has illegal modifications that an inspection is legal. So what happens if you say "No!" Well first the cops can ask you out of the car, and of course you can refuse. Then it will probable come to them ordering you out of the car. Of course you can still probably say "No." Bad things will most likely start to happen. Since they won't know if you are hiding drugs, guns etc at this point. You can be forcefully removed for safety purposes, placed in the back of the patrol vehicle and charged with 148 PC Delaying a Peace Officer and the inspection will continue. Regardless of the inspection results your car will most likely be towed too. Failing to follow the CVC could result in a suspended license after the fact. These are all worst case scenarios that most likely would not occur.

    There is a big difference between "search" and "inspection" as well. A search of your car covers the interior and personable areas where you occupy. An inspection is of the vehicles components under the hood and your emissions system. It is a grey zone for them to start removing or opening things under the hood. Usually frowned upon by prosecutors and lawyers since they could push the "search" issue if they had to remove your valve cover or something along those lines.

    Hey, guys... I tried these techniques before. None of them works.
    Actually, believe it not, when I was taking a speech class in a college probably 8 years ago, we actually talked about this and the methods are very similar to this.
    I still couldn't execute it well though, English is my second language.

    But I found nowadays, cops got smarter, and they try to avoid to talk to you at all cost.
    Example would be,
    Officer walking to my window: Can I get your driver license and registration, and insurance.
    I gave him all that.
    Officer: Do you know you were speeding?
    Me: no, officer, I was just following the traffic and driving safely. ( which was the truth.)
    He then got all my docs and went back to his car.
    I didn't have any chance to talk to him at all.
    After 5 mins... I got a ticket without any conversation... No chances for explanation.

    I did try to request county seat, but he told me you don't have to go to court. So I guess I got denied?
    Anyway, I am driving slow now. And haven't had any problem.
    But Just curious how would you apply the said "what to do" in this case?

    Yifuqiao, the best thing to do if you wish to contest a citation is contact the traffic court division of where you are to appear, and take it from there. Not all courts are the same and they handle cases differently. Either way, handle the cite, if you don't you will get a warrant or possible suspension for FTA (fail to appear), not good. FYI: I could go on and on in this subject matter... Blah Blah.....impounds etc...oh and Lasers which are target specific need to be calibrated/tested. Your radar/laser devices will not defeat/scramble only detect. if there is no front plate to target, another part of vehicle is painted with the laser and viola...reading...

    I was told by a CHP officer awhile back "keep it under 80" He was a nice dude, incredibly professional and let me go with a warning. I was speeding and was honest, he could tell I was having a shitty morning. I woke up late, couldn't find my keys (I have a 3 year old), got in the car and realized I needed to get gas....like this morning couldn't get any worse and then I get stopped. I was doing like 85 or some shit on the 5 north just after oceanside. He walked up, introduced himself, informed me of my violation and asked what was going on, verified my id and what not. Talked to me for a few minutes and even offered to call my boss to let him know I was having a shit day so far. I thanked him and went on my way.

    Its my opinion that it seems like everyone is always trying to be smarter than the (insert LEO/Agency). Just don't be an asshole and answer the questions respectfully.
