Thread: Speeding ticket on my way to Mammoth

    Speeding ticket on my way to Mammoth

    So I'm sure that any and all of you that snowboard know, the drive out to Mammoth is always full of cops. Knowing this ahead of time, I always try to keep my speed down. Two weeks ago I was driving out to Mammoth at night, around 11pm and I saw a car pulled over on the side of the road, as I approached it, (white hatchback) it pulled in front of me, merging back onto the highway. I slowed since his speed was not up to mine (I was going 65mph slowed to 55mpg) As soon as I passed where he was pulled over, I realized there was a cop car on the side of the road and as soon as I passed him he turned his headlights on. He was sitting in the dark with no headlights on and no street light behind the pulled over hatchback. Another car on the road passed both of us speeding well over 75mph but as soon as I passed the police officer, he pulled up behind me and turned on his lights to pull me over.

    I know for a FACT that I was not speeding but when he pulled me over he said I was going 75-80mph. What would be the best way to fight this other than trial by declaration? Could he have mistaken me for speeding instead of the other car because I drive an Evo. I have been told by a police officer in Bishop that they try to find any way to pull over cars with snowboards on their roof because over 70% of they time they also have weed in their car. Any tips or advice would be appreciated. Thanks :)

    What was marked on your citation? Did it include information of a radar? What agency issues the cite?

    Did you have weed?

    No but just fight with TBD. State what you wrote in the post, and also ask for the officer to provide RADAR/LIDAR evidence, as well as ask for the last calibration test on that device. Also, present the likely possibility that, if indeed the cop had legitimate RADAR/LIDAR evidence, he picked up the speeding car behind you, and not you, since you know you weren't speeding.

    If they tried to bait me to say i was speeding when in fact i was not, then I probably wouldn't sign the ticket, and would wait for him to call another superior officer, and make it known his officer is lying.

    Also, when the headlights are off and police cruiser is on the side of the road, wouldn't that entail entrapment? Hiding on the side of a dark road with your lights off sounds pretty sneaky, and I don't think they are allowed that sneakiness.

    Sorry Gordo...if the officer can still be seen, even by people/cars that the officer is not targeting, still legal.

    I only saw the officer after I passed him when my lights reflected off the side of his car. I did not have weed in the car either. I will double check when I get home about the form of radar used. How could he have even clocked me anyways if he was facing the same direction as traffic behind another car that he just finished pulling over?

    The ticket has both boxes checked for radar/lidar/patrol vehicle no and mvars. It was from the CHP in Bishop. Citation code for speeding was 22349 (a) vc - exceed 65mph. He wrote down that I was going 75+ mph. I don't know how else to phase this for the tbd other than, "oh it wasn't me" haha.

    So would there be a law against a cop sitting in the dark in the side of the road? I want to be as educated as possible before I write my statement.

    Did you get at least fresh tracks two weeks ago in Mammoth when it snowed Thursday, Friday and Sunday! It was epic! I ski'd all day Thursday and Friday in the fresh snow! Fresh tracks all day

    Haha it snowed that Saturday and Sunday and we had a bluebird powder day on Monday. It was pretty rad but my bf fucked up his board and my binding broke also. It was a bad luck weekend haha

    Ooh... well shit. Honestly, only way you're getting out of this is suggesting that his RADAR/LIDAR evidence is faulty and he writes a crappy TBD or doesn't write one at all. Otherwise, it's your word against his, and judges aren't known to be nice.

    Agreed^ that's why I was wondering if anyone knew about any laws regarding cops hiding in the dark. I've never gotten out of a ticket before or even gotten a warning. Cops hate me

    So I guess getting an extension and then writing my TBD would be the best option? Drag it out as long as possible I guess so hopefully the officer doesn't remember as much.

    Extension sounds good. I like that theory, probably worth a shot.

    I won a TBD when i was on 5 south through Pendleton. Officer wrote me for 79 when i could not have been doing more than 70 tops. Not even a possibility. In that car, i always went 65 anyway because of the super short gearing. I remember hearing that the radar reading can be skewed by the angle between the gun and the target, but i haven't really read up on that much. Maybe worth looking into. In this case, cop was on the right side of the hwy, in the middle of a very gradual bend to the right. There was an embankment on the right side there, and i was in the slow lane, so he didn't even have line of sight on me until i was maybe <100 yards from him?

    I based my case on that fact that that i was going the same speed as everyone else, and if anything, slower than most. Obviously 395 is not busy, but maybe it would be worth mentioning that tard that pulled out in front of you, thereby limiting your speed?

    ^ I'm going to try to word it as articulately as possible :) I'll definitely mention that guy that pulled in front of me and the other car that was speeding next to me. Its just a crappy situation since its his word against mine. I freaking hate CHP so much.

    This is hilarious, sorry but cops can "hide" where ever they want

    I'm not your bro, guy :P I'm a respectable woman that doesn't speed :) since you seem to be a cop yourself, any advice? I feel like I should just start driving with my go pro on to avoid all this ridiculousness
